18 U.S.C. 2257 Compliance Statement

Compliance Overview

XpandoraX is committed to full compliance with 18 U.S.C. § 2257 and 28 C.F.R. Part 75 regarding the maintenance of records pertaining to the depiction of actual or simulated sexually explicit conduct. This statement outlines our compliance approach for the different types of content on our platform.

Platform-Managed Content

For content managed directly by XpandoraX through our content management system (Sanity CMS):

• We maintain relationships with content producers who are the primary producers as defined under 18 U.S.C. § 2257
• All content producers and studios listed on our platform have represented and warranted that they maintain the required 2257 records
• Producer and studio profiles on our platform include identifying information to facilitate contact regarding records

User-Uploaded Content

XpandoraX allows approved content partners and VIP subscribers to upload content through our creator dashboard. For all user-uploaded content:

• Uploaders must agree to our Terms of Service which require compliance with 18 U.S.C. § 2257
• Uploaders represent and warrant that all individuals depicted were at least 18 years of age at the time of creation
• Uploaders represent and warrant that they have obtained valid photo identification and age verification for all performers
• Uploaders represent and warrant that they maintain all required records as the primary producer
• All uploaded content undergoes a review process before publication

Embedded and Third-Party Content

For content that is embedded from or linked to third-party hosting services:

• XpandoraX is not the primary producer of such content as defined in 18 U.S.C. § 2257
• The original producers of embedded content are responsible for maintaining the records required by 18 U.S.C. § 2257
• Original producers may be identified by examining credits, watermarks, or other identifiers appearing in the content

Content Provider Warranties

All content providers (including producers, studios, and user uploaders) on the XpandoraX platform warrant that:

• All individuals depicted in visual depictions of actual or simulated sexually explicit conduct were at least 18 years of age at the time of creation
• They have obtained valid government-issued photo identification and age verification for all performers
• They maintain all records required under 18 U.S.C. § 2257, including cross-referencing records of performers' legal names to stage names
• They have the necessary rights, licenses, and authorizations to distribute the content
• Records are available for inspection at their designated custodian of records location

Age Verification

XpandoraX requires all visitors to confirm that they are at least 18 years of age (or the age of majority in their jurisdiction, whichever is greater) before accessing the website. This verification is performed through our age gate system upon first visit. Additionally, all registered users must confirm their age during the account creation process.

Custodian of Records

For content where XpandoraX acts as secondary producer, records required pursuant to 18 U.S.C. § 2257 are maintained by the respective primary producers. For questions regarding specific content records, please contact the original producer identified in the content.

Reporting Concerns

If you have any concerns about the compliance status of any content appearing on our website, believe any content may involve minors, or believe any content may violate 18 U.S.C. § 2257 or any other applicable law, please report it immediately. We take all such reports extremely seriously and will investigate promptly.

Content Removal

XpandoraX takes all reports seriously and will promptly investigate and remove any content that violates our policies or applicable law. Content that is found to lack proper 2257 documentation will be removed immediately. Content removal requests and compliance reports should be sent to compliance@xpandorax.com

Zero Tolerance Policy

XpandoraX has a zero tolerance policy for any content involving minors. Any content that is found to depict, or is suspected of depicting, any individual under the age of 18 will be immediately removed and reported to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC). Users who upload such content will have their accounts permanently terminated and may face legal action.
